RIDER/MINOR RELEASE AND WAIVER OF LIABILITY
AND INDEMNITY AGREEMENT
In consideration of being permitted to enter for
any purpose this restricted area (herein defined
as including but not limited to the racing track, pit
areas, infield,
starting area, mechanics area, walkways, grandstands,
concessions and other areas appurtenant to any
area where any activity, to include competition, related
to this
event shall take place), or being permitted to
participate in any way in this event:
I/we, for myself
and/or any minor participant,
my personal representatives, heirs and my next
of kin acknowledges, agrees, and represents that
I/we have,
or will immediately upon entering said restricted
areas, inspect said areas and warrant that if,
at any time I/we
is in or about any restricted areas and I/we
feel anything to be unsafe, I/we will immediately advise
the
officials
of such and will leave the restricted areas.
I/we, for myself and/or any minor participant hereby
release, waive and covenant not to sue and discharge
the promoter, participants, Winchester Speedpark LLC/
WSP Holdings LLC or any subdivision thereof, track
operator, officials, any persons in restricted areas,
sponsors, advertisers, owners and lessees of premises
used to conduct the event, and each of them, their
officers and employees, herein referred to as "releasees" from
all liability to the undersigned, his personal representatives,
assigns, heirs, and next of kin for any loss or damages
and any claim or demands therefore on account of injury,
including death, to my person or property whether caused
by the negligence of the releasees or otherwise while
I/we is in or upon the restricted areas and/or competing,
officiating, observing, working for or for any purpose
participating in the event.
I/we, for myself and/or any minor participant hereby
agree to indemnify and save and hold harmless the releasees
and each of them from any loss, liability, damage or
cost they may incur due to the presence of the undersigned
in or upon the restricted areas or in any way competing,
officiating, observing, working for or for any purpose
participating in the event whether caused by the negligence
of the releasees or otherwise. I/we for myself and/or
any minor participant hereby assume all risk and full
responsibility for any bodily injury, death or property
damage due to the negligence of releasees or otherwise
while in or upon the restricted area and/or while competing,
officiating, observing, working for or for any purpose
participating in the event.
I/we for myself and/or any minor participant hereby
expressly acknowledge and agree that the activities
of the event are inherently dangerous and involve the
risk of serous injury and/or death and/or property
damage. I/we for myself and/or any minor participant
further expressly agree that the forgoing release,
waiver and indemnity agreement is intended to be as
broad and inclusive as is permitted by the law of the
State in which the event is conducted and that if any
portion thereof is held invalid, it is agreed that
the balance shall continue in full legal force and
effect.
I/we for myself and/or any minor participant state
that I/we have read and voluntarily signed the release
and waiver of liability and indemnity agreement and
further agree that no other oral representations, statements
or inducements have been made. Each of the undersigned
parents or legal guardians for any minor participant
hereby agree to indemnify and save and hold harmless
the releasees and each of them from any loss, liability,
damage or cost they may incur due to the presence of
the undersigned in or upon the restricted areas or
in any way competing, officiating, observing, working
for or for any purpose participating in the event whether
caused by the negligence of the releasees or otherwise.

BELIEF ALL STATEMENTS SET FORTH
